In the name of God Amen I Mary Hurst of Mansfield in the County of Nottingham widdow do this Thirteenth Day of July in the Seventh year of the Reigne of our Sovreign Lord King George the Second according to the Computation of the Church of Great Brittain One Thousand Seven Hundred and Thirty Three make and ordain this my Last Will and Testament in manner following
First I will that my Debts and Funerall Charges be truely paid and Discharged.
Item I give to my Son Nathaniel Hurst the summe of Two Hundred pounds of which he has already had One Hundred at severall times for which I have Bills to show but it is my will that he shall not be hereby obliged to pay any Interest which shall or may be due to me for any of the Moneys he has had of me but shall have the said Bills given him in freely and so much money as shall make up the summes contained in the said Bills Two Hundred pounds
Item I give and bequeath unto George Fletcher son of Henry Fletcher of Sutton in Ashfield in the said County of Nottingham all and singular my Lands Tenements and Hereditaments with their and every of their appurtenances at Pinxton or else where in the County of Derby lately the estate of Thomas Duffield and all my Estate Right Title and Interest in the same To hold to him the said George Fletcher his Heirs and Assigns for Ever and the Rest of my Lands Tenements and Hereditaments both Freehold and Copyhold that is in my power to dispose of I give devise and bequeath to the said Henry Fletcher and John Chatwin of Mansfield aforesaid maltster their heirs and assignes in Trust as hereafter is declared touching the same I also give and bequeath to them the said Henry Fletcher and John Chatwin their Executors and Administrators all my mortgages Bills of Sale Bonds ready moneys Goods Chattles personal estate whatsoever and wheresoever the same can be found in Trust as hereafter is declared touching the same That is to say as for touching my said Real Estate and as for and touching my said personall estate In Trust that they the said Henry Fletcher and John Chatwin their Heirs Executors and Administrators or some of them shall and do with what convenient speed may be next after my decease Sell and Dispose of my real Estate (Except what is before given to George Fletcher in Fee and what is not in my power to dispose of but will go to my son Nathaniel Hurst after my Decease) and my Copyhold Estate for the best advantage that can be made thereof and also shall sell and Dispose of my personall Estate and collect and call in all the moneys due to me Mary Hurst Mortgages Bills of Sale Bonds or otherwise and then my mind and will is that they the said Henry Fletcher and John Chatwin their Executors and Administrators or Assigns shall and do put forth at Interest the moneys arising by sale of my Real and personal Estate aforesaid and shall and do pay and Dispose of the same to the several and Respective persons hereafter in this my will named and to the uses hereafter mentioned That is to say I will order and appoint the Interest of Four Hundred pounds to be paid yearly to Mary Hopewel my Daughter or to her Assignes dureing the natural Life of her husband Robert Hopewel provided she the said Mary my daughter so long live at two equal payments in the year to witt at Lady day and Michaelmas the first half yearly payment to begin and to be made at and upon which of the said days shall next happen after my decease and in case she my said Daughter Mary survive her said husband then it is my will that imediately after his Decease the said Interest shall be no longer paid her but then I appoint my said Trustees their Executors Administrators or assignes to pay my said Daughter the full summe of Four Hundred pounds for her use during her natural Life and at her decease the said Four Hundred pounds shall be divided as follows to witt Fifty pounds a piece shall be given to her Seven Children as follows if they shall then be liveing to witt to her son John Fifty pounds to her son Robert Fifty pounds to her son Daniel Fifty pounds to her son Nathaniel Fifty pounds to her son James Fifty pounds to her son George Fifty pounds and to her Daughter Ann Fifty pounds and the other Fifty pounds to be to be divided amongst such of her Children as shall be under the age of Twenty one years and in Case any of the said Children should dye before they attain to the age of Twenty one years then it is my will that such Child or Children's share so dying shall go to and be paid to the survivour or survivours equally share and share alike but if my said Daughter Mary shall dye before her said husband then my mind and will is that imediately after her decease the said Legacies of Fifty pounds a piece shall be paid to such of her Children as shall then have attained the age of Twenty one years and the remainder to be put out to Interest and the Interest thereof to be paid yearly by my Trustees their Executors and Administrators or Assignes to and for the maintenance and Education of such Child or Children of the body of my said Daughter Mary lawfully Issueing as shall be liveing at the time of her decease untill such Child or Children shall attain the age and ages of Twenty one years and when such Child or Children shall respectively attain to the age of Twenty one years they shall receive the said Legacy of Fifty pounds as they shall respectively attain to the age of Twenty one years as aforesaid and as for touching and Concerning the Interest of all other my personall Estate (except the said summe of Six Hundred pounds already bequeathed) I do give the same and order it to be paid to my Daughter Elizabeth Fletcher wife of Henry Fletcher (one of my Trustees) for and dureing her natural life only at two equal payments yearly the first payment to begin at the End of six months which shall next happen after my decease and from and after the decease of my said Daughter Fletcher I give the principal summe of which she shall have received the Interest dureing of her Life by virtue of this my will to and amongst her Children of her body lawfully Issueing (her son George only excepted who is to have an advantage thereof I haveing before in this my will provided for him) equally share and share alike to be paid to them severally and respectively as they shall severally and respectively attain their ages of Twenty one years and in Case any of them shall dye before such age then I give the share of him or her or them so dyeing to the Survivour or Survivours equally amongst them.
Item I hereby Constitute and appoint the said Henry Fletcher and John Chatwin full and joynt Executors of this my last will in Trust as aforesaid and do hereby order and direct and impower them in the first place to detain in their hands out of my principal Estate two guineas which I give them for their pain and trouble and also to detain all such summe or summes of money as they shall lay out Expend or be put upon to Expend in seeing this my will performed or in or about the performance of the same
In Witness whereof I have to this my last will and Testament Contained and written on three sides of one sheet of paper to the two first sides of which I have subscribed my name and to the last side have set my hand and seal the day and year at the beginning of this my will first written
