2. Joseph SCRIVENER [21674] was born in 1733 in Potterspury Northamptonshire England, was baptised on 20 Jan 1733 in Great Barr Staffordshire England, and died in 1807 in Potterspury Northamptonshire England at age 74.

General Notes: In October, 2009, Ruth Wisz sent the Will of Joseph Scrivener, as follows:
This is the last Will and Testament of me Joseph Scrivener of Potterspury in the County of Northampton Gentleman being of sound memory and understanding ffirst I direct that all my just debts ffuneral and Testamentary Expenses shall be fully paid and satisfied and I give and bequeath unto my son Joseph Scrivener the ffurniture in and belonging to my best Bed Chamber being the whole of the Household Goods and ffurniture that I am now possessed of having already disposed of the rest to my son Richard also I give and bequeath unto my said son Joseph Scrivener all my Lands Notes Mortgages in ______ for years ready money and Monies that shall be owing to me at the time of my Decease whether on security or otherwise and I also give and devise unto my said son Joseph Scrivener his Heirs and Assigns all and every my Messuages Cottages Closes Lands Tenements and Habitaments whatsoever situate and being at Potterspury aforesaid and in Passenham ffurtho and Cosgrove in the said County of Northampton or elsewhere with their Appurts to hold that same and every part thereof unto my said son Joseph Scrivener his Heirs and Assigns forever Subject nevertheless to and I do hereby charge all my said Real and Personal Estate so given and devised to my said son Joseph Scrivener as aforesaid with the payment of my Debts ffuneral and Testamentary Expenses and also with the payment of the several Legacies of sums of Money to my younger Children manner hereinafter given and directed that is to say I give and bequeath unto my son Robert the sum of Two hundred and fifty pounds also I give and bequeath unto my Daughter Ann the like Sum of Two hundred and fifty pounds also I give and bequeath unto my Daughter Eleanor the like the like Sum of Two hundred and fifty pounds also I give and bequeath unto my son Thomas the like Sum of Two hundred and fifty pounds also I give and bequeath unto my son John the like sum of Two hundred and fifty pounds and also I give and bequeath unto my said son Richard the Sum of Two hundred pounds which said several Legacies or Sums or Money From order and direct shall be paid by my said son Joseph Scrivener within Twelve months after my Decease and I give and bequeath unto my said son Joseph Scrivener the sum of five pounds which I desire him to lay out in the purchase of Bread and to distribute the same immediately after my Decease unto and amongst such of the poor of the Parish of Potterspury aforesaid as he shall think most deserving and lastly I do hereby nominate constitute and appoint my said son Joseph Scrivener Executor of this my Will and do hereby revoke all other Wills and Testamentary Instruments heretofore by me made In witness whereof I the said Joseph Scrivener the Testator have to this my last Will and Testament contained in two sheets of paper and to each sheet thereof set my hand and seal the fourteenth Day of March in the year of our Lord one thousand eight hundred and seven /__/ Joseph Scrivener /__/ Signed sealed published and declared by the said Testator Joseph Scrivener as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses /__/ Thos Worley /__/ George Adams /__/Thos Jones

after the Act

This Will was proved at London with a codicil on the fifth Day of June in the year of our Lord one thousand eight hundred and seven before the worshipful Samuel Pearce Parson Doctor of Laws Surrogate of the Right Honourable Sir William Wynne Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of Joseph Scrivener the son of the deceased and the sole Executor named in the said Will to whom admon was granted of all and Singular the Goods Chattels and Credits of the said deceased having been first sworn duly to administer.

This is a Codicil to be annexed to and taken as part of the last Will and Testament of me Joseph Scrivener of Potterspury in the County of Northampton Gentleman bearing Date the fourteenth Day of March last whereas I did in and by my said Will give and bequeath to my Daughter Ann the sum of Two hundred and fifty pounds to be paid to her by my son Joseph Scrivener within Twelve Months after my Decease Now I do by this codicil give and bequeath the said Ann of Two hundred and fifty pounds unto my said son Joseph Scrivener and my son Richard Scrivener upon Trust that they the said Joseph Scrivener and Richard Scrivener or the survivor of them his Executors or admors do and shall within Twelve Months after my Decease place the said Sum of two hundred and fifty pounds out at Interest upon such security as they shall think proper and pay the Interest thereof as they shall receive the same unto my said Daur Ann to her own sole and separate use free from the Debts Demand or Control of her present or any future husband and I direct that the said Joseph Scrivener and Richard Scrivener and the Survivor of them his Exors and admors shall pay the said Sum of Two hundred and fifty pounds unto my said Daur Ann in such shares and proportions and at such times as she shall have occasion for the same and that my said Daughters Receipt alone notwithstanding her coverture shall be a sufficient Discharge for the said Principal Interest Money or any part thereof and I do hereby ratify and confirm my said Will in all other particulars thereof In Witness whereof I the said Joseph Scrivener have to this Codicil set my hand and seal this Eleventh Day of April in the year of our Lord one thousand eight hundred and seven /__/ Joseph Scrivener /__/ Signed sealed published and declared by the said Joseph Scrivener the Testator as and for a Codicil to his last Will and Testament in the presence of us /__/ Thos Worley /__/ George Adams /__/

Joseph married Elizabeth DEVONSHIRE [21675] [MRIN: 8604], daughter of Abraham DEVONSHIRE [21678] and Mary BASS [33485], in 1759 in Banbury Oxfordshire England. Elizabeth was born in 1739 and died in 1780 in Potterspury Northamptonshire England at age 41.
